Thomas & Friends, RC2- Class Action Suit

I’m going to disclaimer this with the fact that THOUGH I think i would have made an excellent lawyer ;) I hate law suits. However, we all know that this “china thing” is such a huge issue to me that I want to do all I can to make a point. |

If you follow my Mom Blog, or read some of the first posts on this blog, you will know that my children love Thomas the train. They had one of the trains (one of their favorites) recalled. I did what you all need to do if you haven’t already (if you have children) and called their dr. She ordered an immediate blood test.



Thankfully they both came back negative.

I just opened the bills. The ones the RC2 says they will not pay for. And I just don’t want to pay it.

A little more insight into me- I hate unpaid bills. I’m super type-a about paying bills right when we get them. This used to bug my husband when I took care of the bills. But I hate the idea of being “indebted” or my credit getting tainted.

So for me not to pay a bill??? Big deal. HUGE DEAL!

I googled Thomas, RC2 corp, and Class Action. VOILA! Please read below if you have a recall… follow the link and submit application to the class application. Even if you are someone that doesn’t give a rip about spending $50 on a lead test. They should be paying, not us. Not to mention I will be getting them tests regularly now.

HBSS filed a class action lawsuit against the Thomas the Train manufacturer, RC2, claiming the company acted negligently in the production and distribution of its Thomas & Friends Wooden Railway toys.

The toys were produced with red and yellow surface paint that contains lead. The use of lead paint is forbidden and can cause severe injury to young children and exposure to high levels can result in death.

The Consumer Product Safety Commission issued a voluntary recall on June 14, 2007 and the company is offering a product replacement program, but no reimbursement.

The toys in question range in production from January 2005 to June 2007. It is estimated that more than 1.5 million toys were distributed in this period.
